Taking the title of his book from Isaiah Berlin's famous essay distinguishing a negative concept of liberty connoting lack of interference by others from a positive concept involving participation in the political realm, Samuel Fleischacker explores a third definition of liberty that lies between the first two. In Fleischacker's view, Kant and Adam Smith think of liberty as a matter of acting on our capacity for judgment, thereby differing both from those who tie it to the satisfaction of our (...) desires and those who translate it as action in accordance with reason or "will." Integrating the thought of Kant and Smith, and developing his own stand through readings of the Critique of Judgment and The Wealth of Nations, Fleischacker shows how different acting on one's best judgment is from acting on one's desires--how, in particular, good judgment, as opposed to mere desire, can flourish only in favorable social and political conditions. At the same time, exercising judgment is something every individual must do for him- or herself, hence not something that philosophers and politicians who reason better than the rest of us can do in our stead. For this reason advocates of a liberty based on judgment are likely to be more concerned than are libertarians to make sure that government provides people with conditions for the use of their liberty--for example, excellent standards of education, health care, and unemployment insurance--while at the same time promoting a less paternalistic view of government than most of the movements associated for the past thirty years with the political left. According to the Doctrine of Doing and Allowing, it is more difficult to justify doing harm than it is to justify allowing harm. Enabling harm consists in withdrawing an obstacle that would, if left in place, prevent a pre-existing causal sequence from leading to foreseen harm. There has been a lively debate concerning the moral status of enabling harm. According to some (e.g. McMahan, Vihvelin and Tomkow), many cases of enabling harm are morally indistinguishable from doing harm. Others (e.g. Foot, (...) Hanser) support the Equivalence Hypothesis, according to which enabling harm is morally equivalent to allowing harm. Here I argue that there is every reason to embrace, and no reason to reject, the Equivalence Hypothesis. (shrink)

Conviction Narrative Theory (CNT) is a theory of choice underradical uncertainty– situations where outcomes cannot be enumerated and probabilities cannot be assigned. Whereas most theories of choice assume that people rely on (potentially biased) probabilistic judgments, such theories cannot account for adaptive decision-making when probabilities cannot be assigned. CNT proposes that people usenarratives– structured representations of causal, temporal, analogical, and valence relationships – rather than probabilities, as the currency of thought that unifies our sense-making and decision-making faculties. According to CNT, (...) narratives arise from the interplay between individual cognition and the social environment, with reasoners adopting a narrative that feels “right” to explain the available data; using that narrative to imagine plausible futures; and affectively evaluating those imagined futures to make a choice. Evidence from many areas of the cognitive, behavioral, and social sciences supports this basic model, including lab experiments, interview studies, and econometric analyses. We identify 12 propositions to explain how the mental representations (narratives) interact with four inter-related processes (explanation, simulation, affective evaluation, and communication), examining the theoretical and empirical basis for each. We conclude by discussing how CNT can provide a common vocabulary for researchers studying everyday choices across areas of the decision sciences. (shrink)

This paper explores the Australian community’s reaction to the deportation of unvaccinated tennis star, Novak Djokovic, in the lead up to the 2022 Australian Open. The analysis interprets the community’s hostile reaction to Djokovic by understanding community as both a structural and dynamic concept and, even more so, how fluid, evolving macro influences of community or group identification can intensify the demands of individuals to compromise for the common good based on ingrained expectations of the community. To do this, Norbert (...) Elias’ concepts of figurations and ‘we-they’ group identities are used to help highlight the link between structural and dynamic theories of community and identity. This study also outlines how ‘what is fair’ lies in pre-existing community rules and conventions being influenced by often momentary factors that impact and often change forms of group identity. These changes can be temporary or long-lasting and are driven by macro influences such as COVID-19 that can intensify existing community tensions. Throughout the analysis, it becomes clear that community’s response to Djokovic was not only fair, but a logical manifestation of community. (shrink)

This paper argues that God, despite his Perfection, can have faith in us. The paper includes exegesis of various Midrasihc texts, so as to understand the Rabbinic claim that God manifested faith in creating the world. After the exegesis, the paper goes on to provide philosophical motivation for thinking that the Rabbinic claim is consistent with Perfect Being Theology, and consistent with a proper analysis of the nature of faith. Finally, the paper attempts to tie the virtue that faith can (...) exhibit to the virtues associated with art, as it is understood by R. G. Collingwood. This association is particularly apt, given the Midrashic description of God as an artist. All of this is offered in response to Rabbi Moses Nachmanides who argued that Abraham’s faith, in Genesis 15:6, wasn’t worthy of particular praise. (shrink)

Ricœur’s philosophy never locates itself directly in the field of philosophical aesthetics inasmuch as philosophical aesthetics never arises as a field of major questioning and discursive development for Ricœur’s philosophy or as a field that would guide that philosophy. However, Ricœur maintains an ongoing but complex connection with aesthetics throughout his philosophical work. Here we defend the thesis that there are difficulties relating both to the complexity of Ricœur’s philosophy and to the crisis situation of aesthetics as an autonomous field (...) of philosophical inquiry. A more direct confrontation with philosophical aesthetics, such as that developed by analytic philosophy and critical theory today, is necessary in order to be aware of this connection between Ricœur’s philosophy and aesthetics. It then appears that if Ricœur’s philosophy makes it possible to maintain a certain autonomy of the field of aesthetics inherited from Kant, it is not through developing some unlikely “Ricœurian aesthetic” but thanks to a Ricœurian philosophy of aesthetics essentially determined on three levels: 1) the connection between poetics and aesthetics within a philosophy of imagination, 2) the connection between criticism and hermeneutics with regard the notions of text and distanciation, 3) the connection between ontology and communication that summarizes the two previous steps by combining phenomenological, analytic and critical perspectives. Thus it can be assumed that this autonomy of the field of aesthetics is possible only at a horizon of meaning determined by Ricœur’s philosophical anthropology: at the axiological level, the field of aesthetics differs upstream from the field of poetics and downstream from the field of ethics; at the ontological level, Ricœur’s philosophy of aesthetics concerns a region that is both intermediate between and congruent to those treated by Ricœur’s philosophy of imagination and by Ricœur’s philosophy of action. La novela de Ishiguro _ Nunca me abandones _ (2005) suele calificarse de distópica, asumiendo que refleja una inaceptable injusticia al plantear la explotación de clones de humanos, ‘donadores’ de órganos para sus humanos originales. Empero, el concepto de distopía no puede caracterizar la situación descrita de manera absoluta, pues para la humanidad original realmente no hay un mal funcionamiento social; por su parte, a pesar de padecer enajenación orgánica y la restricción a su libertad, en la novela no hay (...) rebeliones de clones o crisis humanitaria sufrida por los clones. Pudiendo reflejar una utopía, provoca indignación y se categoriza como distopía en el supuesto de que los clones son también humanos o deberían contar como tales, pues así lo parecen. La parcialidad de la categorización distópica revela cierto prejuicio que impide ver que tal es la condición que el ganado enfrenta actualmente en nuestras sociedades. Su explotación no se categoriza como distópica ni injusta, a pesar de que comparte la misma forma de legitimidad en su explotación que los clones (‘para eso son’) y la misma limitación para articular por sí solos la resistencia de manera colectiva y sistemática. Conecto esta reflexión con el análisis de dos ámbitos en los que los animales no humanos son usados para fines no humanos: la experimentación biomédica y la ganadería. (shrink)

A theoretical structure for multiattribute decision making is presented, based on a dynamical system for interactions in a neural network incorporating affective and rational variables. This enables modeling of problems that elude two prevailing economic decision theories: subjective expected utility theory and prospect theory. The network is unlike some that fit economic data by choosing optimal weights or coefficients within a predetermined mathematical framework. Rather, the framework itself is based on principles used elsewhere to model many other cognitive and behavioral (...) data, in a manner approximating how humans perform behavioral functions. Different, interconnected modules within the network encode (a) attributes of objects among which choices are made, (b) object categories, (c) and goals of the decision maker. An example is utilized to simulate the actual consumer choice between old and new versions of Coca-Cola. Potential applications are also discussed to market decisions involving negotiations between participants, such as international petroleum traders. (shrink)

In The Sources of Normativity, Christine Korsgaard affirms that Enlightenment morality is true: humanity is valuable. To many of us few claims seem more obvious. Yet Enlightenment thinkers such as Kant do not limit themselves to affirming that humanity is valuable. They appeal to reason in an effort to establish it. They try to show that, in some sense, we are rationally compelled to recognize the value of humanity. Korsgaard joins in this effort. She champions the claim that unless we (...) take humanity to be valuable, we condemn ourselves to complete practical skepticism, i.e., to the view that we have no reason to do anything at all.Korsgaard discusses two arguments that, she believes, support this claim. The first she attributes directly to Kant in a series of influential papers on his ethics. The second argument, which she calls a ‘fancy new model’ of the first, she constructs under her own name in The Sources of Normativity. I will defend the view that neither of these arguments succeeds. In doing so, I will not be trying to show that we are mistaken in believing humanity to be valuable. (shrink)

Transparency International (TI) is a coalition of individuals that has served as a facilitator against corruption for the past 20 years. The organization first approached its task with a focus on laws concerning corruption and whistleblowing, but corruption does have the capability to win against this institution as well. TI has produced well-known initiatives such as the annual Corruption Perception Index; other formal monitoring includes the Global Corruption Barometer, the Bribe-Payers' Index, the East African Bribery Index, National Integrity Studies, and (...) social auditors present in many nations. Diverse less-familiar initiatives noted here include integrity work in Kenyan election campaigns, monitoring of international professional sports, and integrity clubs at schools and colleges. TI is a coalition of individuals bound together by a common vision of a corruption-free world. A focus on business, a focus on integrity for those within each nation's political system and process, and a truly internation.. (shrink)

Covid‐19 confronts us with tragic choices, in which every option is unacceptable. On the New York State Task Force on Life and the Law, I worked on guidelines for such situations. We did not envision the scale or character of Covid‐19. To minimize fear that the decisions made in these situations might be unfair, we all must know what guidelines or mandates inform them. Only with transparency about how decisions will be made, by whom, and according to what requirements can (...) we have confidence that fairness prevails. We now face many related questions about process, goals, leadership, and trust. For example, how might ethical guidelines evolve as scientific understanding advances? Should guidelines vary with different venues? And if, as I have argued, judgment is necessary even with the best of guidelines, how can we prepare clinicians to make good judgments? Are there implications for better training of personnel in nonemergency times for what they might face in the worst of times? (shrink)

This paper analyzes the necessity and operation of conceptual macromolecule inside Edgar Morin’s school of thought due to the significant connection of his epistemological proposal and the language transformation with which the knowledge of reality is expressed in complex thought. This paper is organized as follows. First, we pointed the essential link between conceptualizer/observer subject and the macro-conceptualization. Second, we interpret the system or complex basic unity expounded in Method I based on complexity principles. Eudaimonia is not about good feelings but rather the fulfilment of human potentials. Fulfilment is made possible by virtue; the moderation of desire and emotion by reason.
